These Terms govern your use of the Contaktly platform. By using Contaktly, you agree to these Terms.

1. Overview

Contaktly provides software that enables businesses to engage website visitors, qualify leads, and book meetings through chat and messaging channels.

These Terms apply to all users of the platform.

2. Your Account

You are responsible for:

Keeping your account details secure
All activity under your account
Ensuring your use of Contaktly complies with applicable laws

You must provide accurate information when creating an account.

3. Use of the Service

You agree to use Contaktly only for lawful business purposes.

You must not use the platform to:

Send spam or unsolicited communications
Mislead or impersonate others
Collect or process data unlawfully
Engage in any activity that could harm the platform or other users

We reserve the right to suspend or terminate accounts that violate these rules.

4. Customer Responsibilities

You are responsible for:

The data you collect through your website and chatbot
Ensuring you have a lawful basis (e.g. consent) to collect personal data
Providing appropriate privacy notices to your users
Complying with GDPR and other applicable regulations

Contaktly acts as a data processor on your behalf.

5. Data and Privacy

Your use of the platform is also governed by our Privacy Policy.

We process data only to provide the service and do not sell customer data.

You retain control over your data and can request deletion at any time.

6. Intellectual Property

All rights to the Contaktly platform, including:

Software
Design
Features
Branding

are owned by Contaktly.

You are granted a limited, non-exclusive right to use the platform during your subscription.

You may not:

Copy, modify, or reverse engineer the platform
Resell or redistribute the service without permission

7. Third-Party Integrations

Contaktly may integrate with third-party services such as:

WhatsApp (Meta)
CRM systems
Calendar tools

Your use of these services is subject to their respective terms.

We are not responsible for third-party services.

8. Service Availability

We aim to provide a reliable service but do not guarantee uninterrupted access.

We may:

Update or improve the platform
Temporarily suspend access for maintenance

We are not liable for downtime or interruptions.

9. Pricing and Payment

If you are on a paid plan:

Fees are billed on a recurring basis
You agree to pay all applicable charges
Payments are non-refundable unless otherwise stated

We may update pricing with reasonable notice.

10. 30-Day Conversion Guarantee

Contaktly offers a 30-Day Conversion Guarantee.

If the platform does not generate a qualified conversation with your website visitors within 30 days, we will continue providing the service at no cost until it does.

This guarantee:

Applies only to active, properly configured accounts
Requires reasonable cooperation from the customer (e.g. setup, integration)
Does not apply in cases of misuse or lack of website traffic

11. Limitation of Liability

To the maximum extent permitted by law:

Contaktly is provided "as is"
We are not liable for indirect or consequential damages
Our total liability is limited to the amount paid by you in the preceding 12 months

12. Termination

You may cancel your subscription at any time.

We may suspend or terminate your access if:

You breach these Terms
You misuse the platform

Upon termination:

Your access will be revoked
You may request deletion of your data

13. Changes to the Service or Terms

We may update the platform and these Terms from time to time.

We will notify users of significant changes.

14. Governing Law

These Terms are governed by the laws of:
